The documents you need in Victoria

In Victoria, the key documents are:

Enduring Power of Attorney (Financial and Personal) This appoints a trusted person, your attorney, to make financial and personal decisions on your behalf. “Enduring” means it remains in force even if you lose decision-making capacity, which is exactly when it matters most. You can specify when it comes into effect and what powers your attorney holds.

Appointment of Medical Treatment Decision Maker — nominates a trusted person to make medical decisions on your behalf if you lose capacity, particularly in respect of your end of life procedures.

Advance Care Directive — records your values, preferences and wishes about medical treatment and future health care, including instructions to refuse specific medical treatments if you become unable to communicate. 


What happens without these documents?

If you lose capacity without an Power of Attorney documents, your family may not be able to automatically step in. They may need to apply to VCAT — the Victorian Civil and Administrative Tribunal — for a Guardianship or Administration order. This process takes time, costs money, and causes significant stress at an already difficult moment.
